The company new medical GmbH & Co. KG acts as an intermediary between patients, doctors and the clinics in the Czech Republic. The contract for the medical services appears directly between the patient and the doctors. Consequently, the doctors are the ones who are liable for the medical services. The new medical GmbH & Co KG is also not liable for the travel, the accommodation in the clinic, hotel or pension, because the contracts are solely agreed between the patients and the intermediary organizers. The company new medical GmbH & Co KG is liable for the intermediation and for the advertised portrayal in Germany according to § 13 Law on Advertising in the Health Care System (Heilmittelwerbegesetz).
